Background
Iban Salinas-Gonzalez was sentenced in February 2024 to 16 months’ imprisonment and three years of supervised release. His supervision began in August 2024. In August 2026, Chief District Judge Amos L. Mazzant III accepted transfer of the supervision matter from the Western District of Texas to the Eastern District of Texas.
The amended revocation petition alleged that Salinas-Gonzalez committed illegal reentry after removal, in violation of 8 U.S.C. § 1326(a) and (b), and failed to report to probation after reentering the United States. At the September 24, 2026 final revocation hearing, he pleaded true to both allegations, consented to revocation, and waived objections to the magistrate judge’s proposed findings and recommendation.
The Court’s Holding
Magistrate Judge Bill Davis recommended finding that Salinas-Gonzalez violated both conditions of supervised release. The recommendation was based on his pleas of true to the allegations that he committed a new offense and failed to report to the U.S. Probation Office following his reentry.
The magistrate judge further recommended revoking supervised release and imposing eight months’ imprisonment, consecutive to the sentence imposed in Eastern District of Texas Case No. 4:26-CR-00025. The recommendation called for no additional term of supervised release and, if appropriate, placement at a facility in the North Texas area.
Key Takeaways
- The filing is a magistrate judge’s report and recommendation, not a final district-court revocation order.
- Salinas-Gonzalez admitted both alleged supervision violations and waived objections to the proposed findings.
- The recommended eight-month revocation sentence would run consecutively to his sentence in a separate Eastern District of Texas case.
Why It Matters
The recommendation illustrates that a new illegal-reentry offense and a failure to report to probation can support revocation of supervised release. It also reflects the court’s reliance on Salinas-Gonzalez’s history of noncompliance in recommending a custodial sentence without further supervision.
